These Terms of Use govern your use of the Home Value real estate platform. By accessing or using Home Value, you agree to comply with these terms and conditions. If you do not agree with any part of these terms, please refrain from using our platform.

1. Use of Home Value

1.1 Eligibility: You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use Home Value. By using our platform, you represent and warrant that you meet these eligibility requirements.

1.2 Account Registration: To access certain features of Home Value, you may be required to create an account. You are responsible for providing accurate and up-to-date information during the registration process and maintaining the confidentiality of your account credentials.

1.3 Acceptable Use: You agree to use Home Value in compliance with applicable laws and regulations. You must not engage in any activity that interferes with or disrupts the functioning of the platform or infringes upon the rights of others.

1.4 Prohibited Activities: The following activities are strictly prohibited on Home Value and will result in account termination:
a) Impersonating any person or entity or falsely representing your affiliation with any individual or organization.
b) Uploading, transmitting, or distributing any harmful or malicious content, including viruses, malware, or any other code that may damage or interfere with the platform.

c) Collecting or harvesting personal information of other users without their consent.
d) Engaging in any form of spamming, unauthorized advertising, or solicitation.
e) Violating any intellectual property rights, including copyrights, trademarks, or patents.

f) Pursuing Buyers or Sellers outside Home Value using information or insight gathered from Home Value. For example, house-visiting potential sellers

2. Intellectual Property Rights

2.1 Ownership: Home Value and its associated content, including but not limited to logos, trademarks, text, graphics, and software, are owned by or licensed to us. All rights not expressly granted herein are reserved.

2.2 Limited License: Subject to your compliance with these Terms of Use, we grant you a limited, non-exclusive, non-transferable license to access and use Home Value for personal and non-commercial purposes.

2.3 Prohibited Use: You must not reproduce, modify, distribute, display, perform, or create derivative works of any part of Home Value without our prior written consent.

3. Disclaimer of Warranties

Home Value is provided on an "as is" and "as available" basis. We do not warrant that the platform will be uninterrupted, error-free, or free from harmful components. We disclaim all warranties, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

4. Limitation of Liability

In no event shall Home Value or its affiliates, partners, or employees be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the platform. Our total liability to you for any claim arising under these terms shall not exceed the amount paid by you, if any, for accessing Home Value.
5. Modifications and Termination

We reserve the right to modify, suspend, or terminate Home Value or any part thereof, at any time and without prior notice. We may also update these Terms of Use from time to time. Continued use of the platform after any modifications constitutes your acceptance of the updated terms.

These Terms of Use shall be governed by and construed in accordance with the laws of New Zealand. Any disputes arising out of or relating to these terms shall be resolved exclusively in the federal courts of New Zealand.
